01Acceptance of Terms
By creating an account or using ShipCollab, you accept these Terms of Service. Processing of your personal data is separately governed by our Privacy Policy; accepting these Terms does not remove the need to separately obtain your consent for any data processing that requires explicit consent. If you use ShipCollab on behalf of a company, you represent and warrant that you have the authority to bind that company to these Terms.
02Eligibility
To create an account you must be at least 18, or the age of legal majority in your country. Brands must be a legally registered business. Creator and brand accounts are subject to approval before they can transact on the marketplace. You warrant that the information you provide is accurate, current, and complete.
03Creator & Brand Accounts
Creators and brands are individually approved before gaining access to the marketplace. ShipCollab reserves the right to review, approve, suspend, or remove any account that does not meet our quality or conduct standards. Approval criteria are at our discretion and may change without prior notice. You are responsible for keeping your account information up to date and for keeping your login credentials secure.
04Campaigns & Collaborations
Brands create campaigns that define deliverables, timing, and payment (Gifted or Paid). When a brand accepts a creator's application, a collaboration agreement is formed reflecting these Terms. Both parties are expected to comply with the terms of an accepted agreement.
05Shipping & Products
Creators share shipping information only after they confirm a collaboration agreement. Brands are responsible for shipping the agreed product on time. ShipCollab is not a shipping carrier and is not responsible for delay, loss, or damage in transit.
06Payment
In Gifted campaigns, the product itself is the full payment. In Paid campaigns, the creator fee stated in the agreement is paid according to the terms agreed between the brand and the creator. ShipCollab does not currently process payment on behalf of either party and has no obligation to track or guarantee that payment has been made. Payment disputes between the parties are resolved directly between them.
07Content Rights & Usage
Usage rights for content produced under a campaign (how long and where a brand may use the content) are set out in each campaign's own guidelines. Unless usage rights are explicitly granted, creators retain ownership of their content. Creators warrant that any content for which they grant usage rights does not infringe the intellectual property rights of any third party.
08Prohibited Conduct
Users may not misrepresent themselves, bypass the approval process, share another user's private information, or use the platform for any unlawful purpose. Violation of these Terms may result in suspension or removal from the marketplace.
09Termination
You may close your account at any time. ShipCollab may suspend or terminate accounts that violate these Terms with reasonable notice, or without notice in urgent cases, particularly for fraud, abuse, or repeated policy violations. Upon termination, any collaboration agreements still in progress are concluded according to their own terms; ShipCollab is not responsible for the performance of those agreements.
10Intellectual Property
The ShipCollab brand, logo, software, and all content on the platform (excluding user-generated campaign content) belong to the ShipCollab team that operates the platform, or to its licensors. These Terms do not grant you any right to copy, reverse engineer, or use the platform for unauthorized commercial purposes.
11Limitation of Liability
ShipCollab provides the marketplace as is and is not responsible for disputes between brands and creators, including but not limited to missed deadlines, product condition, or content quality. Our role is to facilitate the connection and the agreement, not to guarantee outcomes. This limitation does not apply to damages arising from ShipCollab's intent or gross negligence.
12Force Majeure
We are not liable for delay or failure to perform arising from events reasonably beyond our control, such as natural disaster, pandemic, war, cyberattack, or infrastructure provider outages.
13Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Turkey. If a dispute arises between us, we will first try to resolve it directly and in good faith. For disputes that cannot be resolved that way, the competent courts and enforcement offices are determined by the general rules of jurisdiction under Turkish law.
14Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify users through the platform. Continuing to use ShipCollab after changes take effect constitutes acceptance of the updated Terms.
